Terms of Sale

This sale is conducted via mail, phone, fax and e-mail only by Bill and Sue Knous dba/ Railroad Memories. All persons including consignors, Railroad Memories and its principals may bid on lots that do not belong to them personally.

Auction sales are strictly cash in US Funds payable through a bank in the US. Lot(s) purchased must be paid for in full prior to delivery, unless credit arrangements have been specifically agreed to by Railroad Memories.

To expedite delivery lot(s) may be paid for with Visa, Master Card, Discover and American Express. We also accept money orders and personal checks.

All items are guaranteed to be genuine unless otherwise noted. Any claims involving errors in this catalog must be made within five days of receipt of merchandise.

WE ARE NOT RESPONSIBLE FOR ERRORS IN BIDDING!!! Please check your bid sheet carefully to insure you have noted the correct lot numbers. ALL PHONE BIDS SHOULD BE FOLLOWED UP WITH A MAILED, FAXED OR EMAILED BID SHEET. Prices listed are minimum bids, you must bid the minimum or higher or your bids will be disqualified.

In case of duplicate bids on any one item, the earliest postmarked bid sheet and or confirmed phone reserve, fax or email will be awarded the lot. All mailed bids must be received by the deadline date and time. Postmark is not sufficient. No exceptions.

Railroad Memories supplies the name and amount of the back-up bidders to the successful bidder only. Successful bidders names are confidential. Bidders may call to find out the current high bid only after they have placed their bids.

Highest winning bidder will be awarded the lot for 10% above the 2nd highest bid. EX: Winning bid is $50, second highest bid is $30. Winning bidder pays $33 for the lot. If the spread between the two top bids is less than 10% the winning bidder pays his full amount bid. If only one bid is received on any one lot the winning bidder pays the minimum bid only. We encourage you to bid the most you are willing to pay, this saves time and usually is the most successful.

NON SUBSCRIBING BIDDERS AGREE TO PAY A 10% BUYERS PREMIUM.

New member subscription fee is $45 per year for US, $55 for Canada and $65 for Europe. Members are NOT CHARGED a buyers premium! Once you have subscribed a Bidders Pass number will be issued.

Railroad Memories reserves the right to refuse any bid. Any item may be returned for a full refund within 5 days of receipt of merchandise unless the lot is sold on an AS IS basis. PLEASE CALL BEFORE RETURNING ANY ITEM so we can instruct you on the procedure. If an item arrives damaged please keep all original packaging materials.

POSTAGE, SHIPPING, HANDLING and INSURANCE CHARGES ARE THE SOLE RESPONSIBILITY OF THE BUYER. We insure items for the amount paid.

Colorado residents include 3.5%, Denver residents pay 7.1%.

Should a dispute arise in regard to a consigned item and it is 45 days after the close of a catalog, Railroad Memories will no longer be responsible.

Bidders are allowed to call to check the status of their bids. We will tell callers where the current high bid stands, allowing the bidder to see if their bid(s) are high or eliminated, so they may raise or apply the bid to other items. If you raise your bid it is your responsibility to mail, fax or email us an updated bid sheet.
